Experience

David LathamDavid has deep experience representing businesses and senior management in complex business disputes. He has tried over 30 lawsuits, both jury and bench trials. Short of trial, he has achieved millions of dollars in settlements on behalf of plaintiffs. On the defense side, he has successfully represented clients in “bet the company” litigation. He knows the Circuit Court of Cook County and the Northern District of Illinois like the back of his hand. He also has substantial experience arguing appeals, with a number of reported decisions.

David’s value goes well beyond courtroom procedure. He understands that business and financial aspects of a dispute and works with clients to develop smart litigation strategies to achieve the desired objective. He is also adept as helping clients avoid or resolve disputes pre-litigation.

David is just as comfortable in the boardroom as he is in the courtroom. A large law firm veteran who then started his own practice, he deals directly with senior management in handling their most sensitive business disputes. He is experienced with a variety of issues including breach of contract, business fraud, partnership disputes, breakups and freeze outs, financial transactions, business valuations, construction litigation, mechanics liens, and disputes involving general corporate, employment, and corporate management matters.

David currently sits on the board of a not-for-profit entity and serves as the entity’s chief legal counsel; a position that gives him a firsthand perspective on the issues faced by business.
